The Morrison government and the Employer have both applied to the high court to appeal the decision. 

At this time we will not be making changes to our software. 

As an employer you are responsible for complying with the law. If you have any questions about the ruling you should refer to your own legal advice or contact Fairwork. 

If you need to adjust an employees Leave Balance you can do so via Leave History.  Add Manage Leave Balances - Leave History Records

Fairwork have released new Fair Work Information Statement

Appears they have removed (pro-rata) from the Personal leave section.

Their website has not been updated otherwise. We will now refer to our development team for review.

Obviously we can't make changes to our software overnight. Once we have reviewed feasability and considered any changes to our software we will update this page.

Our next major release is due for late October, this may have an impact on that. Please watch this page for updates.

On 21 August 2019, the Full Federal Court of Australia handed down a decision in Mondelez Australia Pty Ltd v AMWU [2019] FCAFC 138. The decision deals with the method of accruing and taking paid personal/carer’s leave for the purposes of the National Employment Standards under the Fair Work Act 2009.
